I work for Progressive and right estimates on cars and see stuff like this all the time...and just to give you the heads up so when the time does come...there is no fixing that car. That thing is a total loss. If you own the car you can retain salvage, but its honestly best to just let them take the car, you take the value of the car, and start over. hopefully it all works out for you!

50/50 comparative state, if they find you less then 50% at fault they will not pay out on the claim. As long as a police report was filed you should be fine. The only thing I see that happens often is if damage to her car is to the rear, some insurance companies will try to say that you should have had time to react while she turned in front of you and only accept 80-90% responsibility....but a lot of factors really depend
